When the Police or VOSA check a driver's tachographs any offences found are likely to be reported to the Magistrates' Court for summons or the matter is dealt with at the roadside by a graduated fixed penalty notice.
 
If a VOSA Traffic Examiner attends at an operator's premises and requests 3 months worth of driver records then any offences that are found will either be dealt with at a Public Inquiry or a summons will  be issued. When a summons is issued both the driver and the company may have to attend Court.
